1. Acceptance of Terms

By accessing or using Fraudiant's email validation and fraud detection service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Fraudiant provides real-time email validation, disposable email detection, and fraud prevention services through our API. The Service helps you verify email addresses, detect temporary email services, and reduce fraudulent signups.

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activity under your account
  • Not share your API keys with unauthorized parties

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to circumvent rate limits or usage restrictions
  • Reverse engineer or attempt to extract source code
  • Resell or redistribute the Service without authorization
  • Use the Service to send spam or unsolicited communications
  • Interfere with or disrupt the Service or servers
  • Violate any applicable laws or regulations

5. Pricing and Payment

Pricing is based on the plan you select. You agree to:

  • Pay all fees associated with your selected plan
  • Provide valid payment information
  • Pay for overages if you exceed your plan limits
  • Accept that fees are non-refundable except as required by law

We reserve the right to change pricing with 30 days notice. Continued use after price changes constitutes acceptance.

6. Service Level Agreement (SLA)

We strive to maintain high availability:

  • Free Plan: 99.5% uptime
  • Pro Plan: 99.9% uptime
  • Enterprise Plan: 99.99% uptime with SLA credits

Scheduled maintenance and force majeure events are excluded from SLA calculations.

7. Data and Privacy

We do not store email addresses or validation results. All processing happens in real-time with zero data retention. See our Privacy Policy for details on how we handle account information.

You are responsible for ensuring you have the right to submit email addresses to our Service and comply with applicable privacy laws.

8. Intellectual Property

The Service, including all software, algorithms, and documentation, is owned by Fraudiant and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service according to these Terms.

9. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee:

  • 100% accuracy of validation results
  • Uninterrupted or error-free operation
  • That the Service will meet your specific requirements
  • That all disposable domains will be detected

You use the Service at your own risk and are responsible for implementing appropriate safeguards.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRAUDIANT SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding the fees paid in the 12 months prior to the claim

11. Indemnification

You agree to indemnify and hold Fraudiant harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any rights of another party.

12. Termination

Either party may terminate the agreement at any time:

  • You may cancel your account at any time from your dashboard
  • We may suspend or terminate accounts that violate these Terms
  • We may discontinue the Service with 30 days notice

Upon termination, your access will cease and any outstanding fees become due immediately.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the European Union and the jurisdiction where Fraudiant is registered. Any disputes shall be resolved in the courts of that jurisdiction.
